Deliveries and Pick-ups

Are bound to suppliers’ Terms and Conditions which can be found on this website.

Pickups

Where a pickup is requested, once the Purchaser has been notified that the Product is ready for pickup, they have seven days in which to pick up the items. After the seven days, items are stored at the rate of $150/week until pickup has occurred.

Deliveries

Purchasers will be notified of the delivery date. On occasion, delivery dates may change due to unforeseen circumstances. In this instance, MBPD will notify the Purchaser via email. Any deliveries that are cancelled by the Purchaser on the day of delivery will incur a re-delivery fee. The Purchaser must provide allweather access at the delivery site and ensure that the access roads and driveways are safe and in good condition for the delivery and this responsibility cannot be waived for any reason. The delivery driver or MBPD will not be held responsible for any damage caused to access roads, pipes of any type, concrete or bitumen driveways, or any other items on the Purchaser’s property.

Damaged products & Shortages

The Purchaser must report any shortages or damage to the delivered products within two days of the delivery. Product deliveries are photographed for documentation purposes. It is the Purchaser’s responsibility to ensure site security from damage or theft.

Products

It is important to note that any products purchased from this sales site do not come with a recommendation from MBPD regarding their use. If applicable, Purchasers may need to seek the services of a Certified Structural Engineer

Roller Doors

MBPD quotes roller door sizes based on the door curtain width, not the opening size. MBPD will not be held responsible if any type of vehicle or equipment does not fit in the opening. It is the responsibility of the purchaser to ensure that the opening size is correct. Please note that the standard roller doors supplied are not wind-rated. If wind-rated roller doors are required, the Purchaser must ensure that they order the correct wind-lock doors. If the Purchaser is unsure, they should confirm their requirements with a Certified Structural Engineer.

Shed Structural Plans

Are provided for one-time use only and cannot be reused for any other site or purpose. The site address details must be provided when placing the order for Shed Structural Plans and cannot be changed after the order for the plan has been processed. It is important to note that these plans are for personal use only and cannot be used for commercial purposes. The Purchaser agrees not to copy, alter or distribute purchased plans. If the plans have been used fraudulently and without permission on any structure, there will be no warranty and the Engineering becomes null and void. Where further information is required regarding the supplied plans, the Purchaser may contact MBPD for the Engineers contact details. There will be no alterations/additions to any Structural Plans. The Purchaser agrees to follow the Plan details; failure to do so will void the Engineering.

Return of Goods

All products that are specifically manufactured for the Purchaser cannot be returned. Including Roller Doors, Sheeting, Gutters and any other specifically manufactured prodct. Any item that is a stock item can be returned although the return transport is at the expense of the Purchaser. Any item returned must be in the same new condition as supplied. Goods accepted for return by MBPD will attract a a restocking charge of at least 15% or an amount to recover restocking and repackaging.

Colour Changes

The Purchaser agrees to the Colours as shown on their order. If colour changes are required, they must be made as soon as possible via email to support@MBPD.com.au along with your Order No and contact details. MBPD will endeavour to change the colours as long as the products have not already been produced. MBPD will not be held responsible for incorrect colour choices. Changes cannot be made once the order has been processed.

Indemnity

The Purchaser indemnifies MBPD of any/all costs associated with any building charges including building charges for incorrectly supplied or short materials. However, if an incorrect supply has been made, MBPD will supply the correct materials as originally ordered and pick up any wrong supply which remains the property of MBPD.

GST

All prices include GST.

Damaged or Faulty Products

If MBPD has supplied products that are found to be damaged or faulty, the items will be replaced if deemed fair by MBPD, however, MBPD will not be held responsible for any labour costs incurred in replacing/building the products in any way. Where MBPD sources products from suppliers we can only offer replacements based on our suppliers’ warranty terms and conditions. Once the Purchaser has accepted and signed for products it is deemed that the products have been supplied in good condition, unless noted on the delivery docket and signed and dated at the time of pick up or delivery.

Compliance

MBPD will comply with relevant laws and regulations regarding fair trading and adhere to the Trade Practices Act and state legislation where applicable.

Force Majeure Event

Any event outside a party’s reasonable control including acts of God, declared or undeclared war, act of terrorism, fire, flood, storm, earthquake, hurricane, cyclone, riot, power failure, industrial action, defaults of manufacturers or suppliers, the inability to obtain equipment, supplies or other facilities that are not caused by a failure to pay, labour disputes, theft, any criminal act, effects of a pandemic or epidemic or other similar events beyond a party’s control that may prevent or delay a party from performing their obligations under any Contract.
